These Terms & Conditions ("Terms") govern your access to and use of the website and digital services at www.gfdavidministries.com, operated by Faith & Miracle International Church — the Incorporated Trustees of Gbemiga Adetuberu Ministry (CAC/IT No. 106881), also known as GF David Ministries. By creating an account, giving, placing an order, registering for an event, submitting content, or otherwise using the Website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Website.
1.1. Faith & Miracle International Church ("FMIC", "the Church", "we", "us", "our") — the Incorporated Trustees of Gbemiga Adetuberu Ministry (CAC/IT No. 106881), also known as GF David Ministries — is a church based in Ibadan, Nigeria that operates the website and digital services at www.gfdavidministries.com (the "Website").
1.2. Unlike a marketplace, FMIC provides its own services directly. We receive giving and partnership contributions, sell our own store products, and organise our own events. We are the party you interact with, not an intermediary between you and a third party.
1.3. These Terms apply to all users of the Website, including members, guests, donors, partners, store customers, event registrants and visitors ("Users", "you").
1.4. We may update these Terms from time to time. Updated Terms will be published on the Website with a revised effective date, and your continued use after that date constitutes acceptance.

3.1. Age. You must be at least eighteen (18) years old to create an account or transact on the Website in your own right. Individuals under 18 may use the Website and provide information only with the verifiable consent and supervision of a parent or legal guardian, who accepts these Terms on the minor's behalf.
3.2. When you create an account, you agree to provide accurate, current and complete information; keep it up to date; keep your login credentials confidential; accept responsibility for activity under your account; and notify us promptly at admin@gfdavidministries.com of any unauthorised use.
3.3. We may, but are not obliged to, verify information you provide. We reserve the right to refuse registration, or to suspend or close an account, where we reasonably believe these Terms or applicable law have been breached.
4.1. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for its intended purposes.
4.2. The Website is provided on an "as is" and "as available" basis. We aim for continuous availability but do not guarantee that the Website will be uninterrupted, error-free, or free from harmful components, and we may suspend access for maintenance, upgrades or security reasons.
4.3. You are responsible for your own device, connectivity and software, and for any costs of accessing the Website.
5.1. Voluntary gifts. All donations, offerings, tithes and partnership contributions made through the Website are voluntary gifts to the Church. They are made freely and, except as set out below, are non-refundable.
5.2. Erroneous or duplicate charges. If you believe a giving transaction was made in error or duplicated, contact us at admin@gfdavidministries.com promptly and we will review it in good faith and, where appropriate, arrange a refund of the affected amount.
5.3. Payment processing. Giving is processed through our third-party payment processors (Paystack and Flutterwave). By giving, you agree to the applicable processor's terms. We do not store your full card or bank details. Amounts are charged in Nigerian Naira (₦); where you select a foreign display currency, the amount is converted to Naira at the applicable rate and charged in Naira.
5.4. Recurring partnership. If you set up an automatic monthly partnership, you authorise the Church (through its payment processor) to charge your saved payment method the amount you selected, on the billing day you selected, each month, until you cancel. You may cancel or change your partnership at any time from your member dashboard or self-manage link, or by contacting us. If a charge fails, we may retry and notify you; repeated failures may pause your automatic giving.
5.5. Records & receipts. We keep records of giving for administrative, financial and legal purposes and may issue receipts or acknowledgements.
6.1. Products & pricing. Product descriptions, prices and availability are shown on the Website and may change. We take care to display accurate information but do not warrant that all product content is error-free.
6.2. Orders. Submitting an order is an offer to purchase; a contract is formed when we confirm the order. We may decline or cancel an order (for example, if a product is unavailable or an error is identified), in which case we will refund any amount paid for the cancelled item.
6.3. Payment. Store payments are processed through Paystack. Prices are in Naira and, unless stated otherwise, include applicable taxes.
6.4. Digital products. Where you purchase a digital product, you receive a limited, personal, non-transferable licence to download and use it. Digital downloads are made available via a secure link after payment.
6.5. Delivery. For physical products, we will deliver to the address you provide within the timeframe and using the method indicated at checkout. Risk passes to you on delivery.
6.6. Returns & refunds. Physical products may be returned within 7 days of delivery if unused and in their original condition; approved refunds are issued to the original payment method. Digital products, once downloaded, are non-refundable, except where required by law or where the product is faulty.
7.1. You may register for events through the Website. Registration is subject to availability and any event-specific terms shown at the time.
7.2. We may change, reschedule or cancel an event; where an event is cancelled by the Church and a fee was paid, we will refund the fee. If you cancel a paid registration, any refund is at the Church's discretion unless the applicable event terms provide otherwise.
8.1. Your responsibility. You are responsible for any Content you submit and represent that it is truthful, that you have the right to share it, and that it does not infringe the rights of, or defame, any third party.
8.2. Publication of testimonies. If you submit a testimony, you understand and agree that it (and any images you attach) may be published on the Website (for example on the homepage or testimonies wall). You grant the Church a non-exclusive, royalty-free licence to display, reproduce and share your testimony and attached images on the Website and in the Church's ministry communications, for so long as you do not withdraw it. Supporting documents are treated as internal and are not published. You may request amendment or removal of a published testimony at any time.
8.3. Prayer requests. Prayer requests are received so the Church can pray for and, where you ask, follow up with you. You may request confidentiality to the ministry team, and deletion, at any time.
8.4. Sensitive information. You may choose to include sensitive information (such as health or family details) in a testimony or prayer request. Please only share what you are comfortable sharing, particularly in a testimony that may be published. Our handling of such information is described in our Privacy Notice (§5 of that Notice).
8.5. Moderation. We may review, decline to publish, edit for formatting, or remove any Content that we reasonably consider inaccurate, unlawful, offensive, or in breach of these Terms. We are not obliged to publish any submission.
You must not: use the Website for any unlawful, fraudulent or harmful purpose; circumvent, disable or interfere with any security feature; use bots, scrapers or automated tools to access or extract data without our written consent; attempt to gain unauthorised access to any part of the Website or its systems; introduce viruses or malicious code; send unsolicited commercial communications (spam); impersonate any person or the Church; submit false, misleading, defamatory, obscene, hateful or discriminatory content; harvest other users' Personal Data without consent; circumvent our payment system; or reverse-engineer or copy the Website. Violation may result in immediate suspension or termination and, where appropriate, referral to the authorities.
10.1. The Website and its content, features, design, software, logos and branding are the property of FMIC or its licensors and are protected by applicable intellectual-property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Website for its intended purposes only.
10.2. You may not reproduce, republish, redistribute, or create derivative works from the Website or its content without our prior written consent, nor use our name, logo or branding without authorisation, nor remove any proprietary notices.
10.3. User Content licence. By submitting User Content (see §8.2), you grant us the licence described in that clause. You retain ownership of your Content.
11.1. Our collection and use of Personal Data is governed by our Privacy Notice, which forms part of these Terms and is available at www.gfdavidministries.com/privacy. By using the Website you acknowledge that Personal Data will be processed in accordance with the Privacy Notice and the NDPA 2023.
12.1. The Website relies on and may link to or embed third-party services (for example, Paystack and Flutterwave for payments, Google Maps for addresses, and YouTube for live streams). Your use of those services is subject to their own terms and privacy policies, and we are not responsible for them. Any dealings with a third party are between you and that third party.
PLEASE READ THIS CLAUSE CAREFULLY — IT LIMITS OUR LIABILITY.
13.1. The Website is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.
13.2. We do not warrant that the Website will be uninterrupted or error-free, or that any content is complete or up to date.
13.3. To the fullest extent permitted by law, our aggregate liability to you arising out of or in connection with these Terms or the Website shall not exceed the amount you actually paid to the Church for the specific product or transaction that is the subject of the claim; and where the claim does not relate to a paid transaction, our total aggregate liability shall not exceed ₦10,000 (ten thousand Naira). Donations and partnership contributions are voluntary gifts and do not give rise to any liability on our part beyond any refund expressly provided under Clause 5.
13.4. We shall not be liable for any indirect, consequential, incidental, special or punitive damages, including loss of profits, data or goodwill.
13.5. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded.
14.1. You agree to indemnify and hold harmless FMIC, its trustees, officers, workers and volunteers from and against any claims, losses, liabilities, damages, costs and reasonable legal fees arising out of your use of the Website, your breach of these Terms or applicable law, your Content, or your conduct towards others.
15.1. We may suspend or terminate your account and access to the Website if we reasonably believe you have breached these Terms, engaged in fraudulent or illegal activity, or created risk or harm to others or the Church.
15.2. You may close your account at any time via your account settings or by contacting admin@gfdavidministries.com. Closing your account does not entitle you to a refund except as expressly provided in these Terms or required by law, and does not affect completed giving.
15.3. Clauses that by their nature should survive termination — including §5 (records/outstanding matters), §8–§10 (content, conduct, IP), §11 (privacy), §13–§14 (liability, indemnity) and §16–§17 (disputes, governing law) — survive.
16.1. If a dispute arises, please contact us first at admin@gfdavidministries.com so we can try to resolve it.
16.2. If it cannot be resolved informally, the parties will seek to resolve the dispute through good-faith negotiation within thirty (30) days, and, failing that, through mediation by a mutually agreed mediator in Ibadan, Oyo State. If mediation fails, the dispute shall be finally resolved by arbitration under the Arbitration and Mediation Act of Nigeria, seated in Ibadan, Oyo State, before a sole arbitrator.
16.3. Nothing in this clause prevents us from seeking urgent injunctive relief from a competent court to protect our intellectual property or prevent irreparable harm. Any dispute must be brought in your individual capacity and not as part of a class or representative action.
17.1. These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Subject to §16, the courts of Oyo State, Nigeria shall have jurisdiction. If you access the Website from outside Nigeria, you are responsible for compliance with your local laws.
18.1. Entire agreement. These Terms, together with the Privacy Notice and any policies referenced, constitute the entire agreement between you and FMIC regarding the Website.
18.2. Amendments. We may update these Terms; the updated version will be posted with a revised effective date, and continued use constitutes acceptance.
18.3. Severability. If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions continue in force.
18.4. No waiver. Our failure to enforce any provision is not a waiver of it.
18.5. Assignment. You may not assign your rights or obligations without our consent; we may assign ours in connection with a reorganisation or transfer of the ministry's operations.
18.6. Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, pandemics, governmental action, civil unrest, or infrastructure failures.
18.7. Electronic communications & acceptance. By using the Website, you consent to receive communications from us electronically, and you agree that creating an account, clicking an acceptance control, giving, placing an order, or otherwise using the Website constitutes your electronic acceptance of these Terms, with the same effect as a handwritten signature.
18.8. Language. These Terms are drawn up in English, which prevails over any translation.
